Utah Mold Pros — Indoor Environmental Assessment Agreement
This Inspection Agreement ("Agreement") is entered into between Utah Mold Pros ("Inspection Company") and the undersigned client ("Client"). By signing this Agreement, Client authorizes Inspection Company to perform the services described herein under the following terms and conditions.
1. Property. Inspection Address: [auto-filled from Section 1]
2. Inspection Fee. The fee for the inspection is $__________. The fee covers one site visit unless otherwise stated in writing. Additional site visits, consultations, sampling, laboratory analysis, or report revisions requested after completion of the inspection may be billed separately.
3. Purpose of the Inspection. The purpose of the inspection is to evaluate readily accessible areas of the property for evidence of moisture intrusion, conditions conducive to fungal growth, and visible or suspected microbial contamination. Depending upon the services purchased, the inspection may include visual inspection, moisture mapping, infrared thermal imaging, indoor air quality measurements, air sampling, surface sampling, wall cavity sampling, HVAC observations, and other environmental measurements specifically requested by Client. Only services specifically purchased are included within the scope of this inspection.
4. Scope and Limitations. This inspection is limited to conditions observed at the time of the inspection. The inspection is not technically exhaustive and does not include every possible defect or environmental condition. Inspection Company does not move furniture, stored belongings, floor coverings, insulation, finished building materials, or personal property. Concealed areas including wall cavities, ceilings, crawlspaces, floor assemblies, ductwork, and inaccessible building components may contain conditions that cannot be identified without destructive investigation. Unless specifically authorized in writing, no destructive testing will be performed. Because environmental conditions continuously change due to occupancy, HVAC operation, weather, cleaning activities, leaks, renovations, or other factors, this inspection represents only a snapshot of conditions existing at the time of inspection.
5. Laboratory Analysis. Laboratory samples are submitted to an independent accredited laboratory for analysis. Inspection Company is responsible for proper sample collection and submission but is not responsible for laboratory testing methodologies, laboratory errors, or analytical conclusions produced by the laboratory. Laboratory results apply only to the specific samples collected and should not be interpreted as representing conditions throughout the entire property.
6. Report. Inspection Company will provide Client with a written report summarizing observations, inspection findings, laboratory results (when applicable), and professional recommendations. The report reflects Inspection Company's professional opinion based upon conditions observed during the inspection. The report is not a guarantee, warranty, engineering report, remediation specification, or prediction of future conditions. No inspection can determine whether mold is completely absent from a structure.
7. Medical Disclaimer. Inspection Company does not practice medicine. Inspection Company does not diagnose illness, determine medical causation, evaluate human exposure, or determine whether environmental conditions caused or contributed to any medical condition. Clients with health concerns should consult qualified healthcare professionals.
8. Remediation Disclaimer. Inspection Company performs independent inspections and testing only. Inspection Company does not perform mold remediation and has no financial interest in recommending remediation services. Inspection Company does not guarantee the effectiveness of remediation performed by others.
9. No Warranty. Inspection Company makes no express or implied warranties regarding future mold growth, future moisture conditions, habitability, or indoor environmental quality after the inspection date. Environmental conditions may change after the inspection.
10. Third-Party Reliance. This report is prepared exclusively for the Client identified in this Agreement. No third party may rely upon this report without the written consent of Inspection Company. This Agreement is not assignable.
11. Limitation of Liability. Client agrees that Inspection Company's maximum aggregate liability arising out of this inspection, the report, laboratory sampling, recommendations, or this Agreement, regardless of the legal theory asserted, shall be limited to the total inspection fee actually paid by Client. Inspection Company shall not be liable for incidental, consequential, indirect, special, or punitive damages.
12. Claims. Client agrees to notify Inspection Company in writing of any alleged deficiency before undertaking repairs, remediation, demolition, or alteration of the inspected area so Inspection Company has a reasonable opportunity to re-inspect the conditions. Failure to provide this opportunity may prejudice Inspection Company's ability to investigate the claim.
13. Time Limitation. Any legal action arising out of this Agreement or the inspection shall be commenced within one (1) year following the inspection date or be forever barred.
14. Venue. Any legal proceeding arising from this Agreement shall be filed exclusively in the state or federal courts having jurisdiction in the county where Inspection Company's principal office is located.
15. Severability. If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement. This Agreement constitutes the complete agreement between the parties. No oral statements or prior representations shall modify this Agreement. Any amendment must be in writing and signed by both parties.
Client acknowledges that they have carefully read this Agreement, understand its contents, have had an opportunity to ask questions, and voluntarily agree to its terms.
